LGPD Week Begins Strengthening The Commitment Of The Judiciary Of The State Of Tocantins To Data Protection

Involving professionals, magistrates and civil servers from the Judicial System of the State of Tocantins, the activities of the week on the General Data Protection Law (GDPR) began by broadening the debate and disseminating knowledge about data protection and information security. Held on Wednesday morning (September 27th), in the auditorium of the Court of Justice of the State of Tocantins (TJTO), the lectures at the Event on Data Protection within the Judiciary and Justice Systems revealed the commitment of the Judiciary of the State of Tocantins to adapting to the new legal requirements of the LGPD.

With the theme "Information Security and LGPD", Police Officer Milena Santana de Araújo Lima, Director of the Institutional Intelligence and Security Center and member of the Personal Data Protection Operational Group of TJTO, together with server Thainá Suzan Silva, technical support analyst in the Maintenance and User Support Division of TJTO, began the discussions by bringing up interesting aspects about the security of personal information.

Drawing attention to the importance of the topic, Milena historically contextualized the process of laws and rules on the security of personal information. "The judiciary has to guarantee justice, but it also has to guarantee security," she said. 

"Transparency is important, but so is the protection of personal data. We need to study how to strike this balance," she said.

For her part, Thainá discussed how to live with and defend ourselves against the methods of attackers in our personal and professional routines, presenting the most frequent scams and the main risk situations. "We have to be careful about what we share on our social networks, because it ends up affecting our lives," she explained.

The analyst gave some tips on how people can protect themselves from these attacks. "In short, the LGPD and information security are fundamental to guarantee the protection and privacy of personal data in the judiciary. It is responsibility of everyone to create a culture of security and to be aware of the risks involved. Together, we can strengthen information security and trust of society," she concluded.

The second lecture was given by Lawyer Maria Lohana Hexana de Moura Silva Siqueira, on the subject of "Challenges and Solutions: LGPD in the Courts". The Lawyer highlighted the need for partnership between professionals in the Judicial System.

"Talking about data protection is a joint effort among civil servers, lawyers and judges; it's important that everyone is aware of the importance of the LGPD," she said.

Maria also presented the themes highlighted in the decisions in which the LGPD is the central issue debated. "The great key to the LGPD is this interdisciplinarity. I have no way of analyzing the LGPD on its own; on its own, it's not enough to be able to protect the rights of people, and the numbers say that," she said.

The third and final lecture of the day was given by Justice Denise de Souza Luiz Francoski, from the Court of Justice of the State of Santa Catarina (TJSC), who dealt with the topic of "Data Protection within the Judiciary". Author of the book "LGPD: Rights of Data Subjects", the Justice focused her presentation on the challenges of the implementation. "It's a great pleasure to be here and to contribute with everyone, with our learnings during this journey. Because the LGPD is a long journey and so are the courts," she said.

At the beginning of her presentation, the Justice explained: "Everything that is here, you will also be able to take this experience to streamline your work with private companies. Everything you do in the public sector can be copied, improved, adapted to the private sector. (...) May this [the lecture] serve as a trampoline so that you can implement data protection in the environments, in the organizations where you provide your services," she explained. 

"Denise also added that "you can't understand the General Data Protection Law just by reading the articles; you need to practice them in your life, you have to build this culture," she said.

Exchange between States

The cooperation between the Court of Justice of the State of Tocantins and the Court of Justice of the State of Tocantins in this knowledge exchange and technology transfer initiative shows their commitment to strengthening the national Information and Communication Technology (ICT) and Data Protection strategy. This collaboration, developed through the Superior School of the Judges of the State of Tocantins (ESMAT), promises to further strengthen data security and privacy in the judiciary.
