Judiciary Of The State Of Tocantins Authorizes Transfer Of Funds From Pecuniary Penalties For Flood Victims In The State Of RS

The Judiciary of the State of Tocantins has also joined the chain of solidarity for those affected by the floods in the State of Rio Grande do Sul. Joint Ordinance No. 6, of May 6th, 2024, authorizes the allocation of amounts from the payment of penalties and alternative measures to the victims.

The funds, according to the Ordinance, must be made through the Civil Defense of the State of Rio Grande do Sul (RS), for the duration of the State of public calamity, declared by the decree no. 57.596/2024, due to the high volume of rainfall, including the occurrence of deaths, disappearances and damage in at least 147 municipalities, since April 24th, 2024.

The Ordinance, signed by the President of the Court of Justice of the State of Tocantins, Justice Etelvina Maria Sampaio Felipe, and by the Chief of Justice, Justice Maysa Vendramini Rosal, follows the Recommendation No. 150, of May 2nd, 2024, of the National Council of Justice (CNJ), which advises the Courts of Justice, the Courts of Military Justice and the Federal Regional Courts to authorize the transfer of resources from the Judiciary to help victims in the State of RS.

"In the face of this tragedy, all help is welcome and we in the Judiciary of the State of Tocantins are doing our part. We also send our prayers and solidarity to the people of the State of Rio Grande do Sul," said the President of the TJTO.

The authorization from the CNJ and the National General Internal Affairs is in line with the institutional policy for the use of resources resulting from the application of the penalty of payment of monetary compensation, expressed in the Resolution 154/2012 of the CNJ and in the Normative Act 0002324-55.2021.2.00.0000, judged in the 6th Virtual Session of 2024 of the CNJ.

According to the rules, the amounts deposited as a pecuniary penalty are destined for a public or private entity with a social purpose, whose beneficiaries provide services of greater social relevance. The General Internal Affairs of Justice of the State of Rio Grande do Sul will be responsible for allocating the amounts transferred to the accredited entities.
