XIV conciliating is cool award will recognize good practices in health, education and labor

The National Council of Justice (CNJ) regulated, by means of the Ordinance 91/2023, the XVIII National Conciliation Week and the XIV edition of the Conciliating is Cool Award, which will reward the courts that obtain the highest score in productivity in the year 2023 and also during the XVIII National Conciliation Week. Good practices in health, land and housing solutions, over-indebtedness, corporate recovery, education, and the labor world, which seek the solution of litigation by a consensual decision between the parties, will be contemplated.

The "Health" category includes contributions that can be replicated in the area of public and private health care and that deal with conciliation, judicial mediation, or any other self-compositive practice. Provided for in the Code of Civil Procedure, self-composition is a form of conflict resolution, through the structuring of dialogue, which leads the parties to make concessions to reach a common point.

In "Land and housing solutions", initiatives that aim at the regularization of settlements will be awarded, the titling of its occupants, and the access to housing, among other measures to ensure the social right to housing, the full development of the social functions of urban or rural property, and the right to an ecologically balanced environment.

In the category on "Over-indebtedness", the focus will be on the application of conciliation and mediation in the situation in which consumers in good faith register their inability to pay their debts, within the contracted period, without compromising the minimum for their survival, under the Consumer Defense Code (Law No. 8.078/1990).

In "Corporate Restructuring" are included the initiatives that can be reproduced in the field of corporate bankruptcy and reorganization, in the interest of legal security, the health of the business environment in Brazil, and the preservation of the interests of creditors, workers, partners in the business being restructured, public treasuries, and society.

In the theme on "Education", programs that deal with the effective dissemination of knowledge about the National Policy for Adequate Dispute Resolution with positive effects in the school or university environment will also be recognized. In the "World of Work" category, replicable contributions that promote the recognition or protection of human dignity in the scope of labor relations will be evaluated.

 

REGISTRATIONS

Members of the judiciary, public servers, professionals who instruct in mediation and conciliation, lawyers, academic and teaching institutions, courts, companies or any private or public entity may apply for the Good Practices modality, through the presentation of self-compositive practices carried out individually or in groups.

The registration of good practices of Judges, magistrates, and public servers must be registered until September 29th, 2023, in the thematic axis on "Conciliation and mediation" of the CNJ Portal of Good Practices of the Judiciary, established by the CNJ Ordinance n. 140/2019. For the other proponents, registrations will take place from September 11th to 29th, 2023, using the form available at the CNJ portal, according to the instructions also published at the portal.

 

CONCILIATION PERFORMANCE

The state, federal, and labor courts that achieve the highest Conflict Composition Index (CIoC) within their segment of justice will be awarded the Conciliating is Cool Award, in the Productivity mode, regardless of registration, with the index calculated for the period November 30th, 2022 to October 31st, 2023.

The promotion and the results of the ICoC will take place in a specific panel produced by the Judicial Research Department (DPJ) of the CNJ, based on the data contained in the National Database of the Judicial Branch (Datajud) established by Resolution CNJ no. 331/2020.

XVIII NATIONAL CONCILIATION WEEK

The XVIII National Conciliation Week will take place between November 6th and 10th, 2023. An "honorable mention" will be awarded to the state, federal, and labor courts that achieve the highest ICoC within their segment of justice for the base period of the event days.

The Datajud update with the processes moved during the XVIII National Conciliation Week and any data that may be necessary to monitor the results of the program must be sent to the CNJ by November 30th, 2023.
