Debate On Judicialization Of Health Gains Space In Publication And Event Of Esmat

The judicialization of health will be one of the themes of the IV Symposium on "Law and Health", to be held on August 1st, in the auditorium of the Court of Justice of the State of Tocantins (TJTO). As a contribution to the debate, the 30th edition of the ESMAT Journal brings the article "The judicialization of health in Brazil and the state of Goiás: a bibliographic study of spending and governance", which analyzes the impacts of this reality on budget management and governance of the Unified Health System (SUS).

Signed by Humberto César Machado, Cinthya Amaral Santos and Suelma Maria Carvalho Gontijo, the study addresses the significant growth of lawsuits aimed at providing drugs and high-cost treatments, often outside the official SUS (public health system of Brazil) list or without registration in Anvisa (National Health Surveillance Agency). The analysis is based on scientific publications and official data produced between 2015 and 2023.

The article highlights the importance of public policies that reconcile the right to health with the sustainability of the system, proposing greater articulation among managers, health professionals, magistrates and civil society. The expansion of drug lists, investment in clinical protocols and inter-institutional dialogue are some of the suggestions pointed out by the authors

Programming

The IV Symposium, promoted by the Superior School of the Judges of the State of Tocantins  (Esmat), in partnership with the Institute for Supplementary Health Studies (IESS), will bring together authorities and experts from all over the country, with the aim of fostering technical-legal dialogue on the effects of judicialization and the alternatives for a more efficient, transparent and safe action in the health area.

Among the confirmed names are the Ministers Ricardo Villas Bôas Cueva and Antonio Saldanha Palheiro, of the Superior Court of Justice (STJ); Justice João Pedro Gebran Neto, coordinator of the National Health Forum of the CNJ (National Council of Justice); and representatives of the National Agency for Supplementary Health (ANS), in addition to lawyers, magistrates and medical professionals.

The full programming of the symposium includes panels on artificial intelligence, evidence-based medicine, legal security, among other topics relevant to the improvement of health decisions.
