Experts discuss ethical and legal issues of ai use during seminar

The second day of the Seminar on "The Future of Business and Justice 5.0" began on Friday afternoon (April 28th), with discussions on ensuring the proper and responsible use of Artificial Intelligence and other technological innovations. Artificial Intelligence is already used in various activities of the Judiciary, from research of jurisprudence to the analysis of cases. However, the use of these technologies raises important ethical, legal, and social issues.

The first panel, entitled "Legal Framework of AI and Technological Innovations", was chaired by Justice Marco Villas Boas, General Director of the Superior School of the Judges of the State of Tocantins (ESMAT) and President of Copedem. In this first moment, the table had the presence of the Minister Ricardo Villas Bôas Cueva, from the Superior Court of Justice; Doctor Francisco Soares, Vice-President of government relations at Qualcomm; Doctor Márcio Gonçalves, Director of corporate affairs at Microsoft; and Doctor Tais Tesser, Senior Lawyer of litigation at Google.

During his speech, Minister Ricardo Villas Bôas Cueva stressed the importance of technological innovation and regulation to ensure the entry of new companies and contributions to the market. He emphasized the need for regulation to be done in a tentative manner, without imposing excessive burden on the regulated, in order to avoid damage or prevent the entry of small companies. In addition, the minister also addressed the threat to intellectual property brought by Artificial Intelligence, especially regarding the lack of attribution of the source and the use of the work, which can mix content from different authors.

"Another very important issue is the one of copyright and intellectual property rights, which, with the Artificial Intelligence, is now threatened in unprecedented ways. This occurs mainly with degenerative Artificial Intelligences, which use large language models and do not make attribution of the source, origin and use of the work, which can result in the mixing of various contents originated from different authors," he commented.

During his comments, Justice Marco highlighted the importance of brain-machine relations in the current technological development and how the perspective of quantum physics brings a new context of changes in these cycles. He pointed out that from 2023 to 2026, much impact is already promised in relation to this whole concept of the development of disruptive technologies, which can further impact the life of humanity and the rights of the citizen. "Legal certainty is important not only for the user, but also for those who produce. So that later on you don't have to go through situations of answering for abuses before the Judiciary in the face of legislation," he added. The Justice also mentioned his concern with social exclusions, since not everyone has the necessary and safe access to the platforms and systems.

The second panel focused on debates about the new forms of work and the legislative and legal impacts in Brazil. Presided by Minister Douglas Rodrigues, from the Superior Labor Court, the panel included Doctor Claudia Viegas, researcher from LCA Consultants, and Doctor Carolina Tupinambá, lawyer and professor.

During the rest of the day, two more panels were developed focusing on "Corporate Legal and Justice 5.0" and "Regulation and Risks". The Seminar is being held in the city of Rio de Janeiro (RJ) and is a realization of the Permanent College of Directors of State Schools of Magistracy (COPEDEM) in partnership with the Superior School of the Judges of the State of Tocantins (ESMAT).
