Access to personal data by hackers and use of confidential information by the Public Sector are debated in the second panel on the General Law of Data Protection (LGPD) - Trends and Challenges

The Second Panel of the cycle of panels on the General Law of Data Protection (LGPD) - Trends and Challenges, promoted by the Permanent College of Directors of State Schools of Judges (COPEDEM) in partnership with the Association of Brazilian Magistrates (AMB), the National School of Judges (ENM) and the Superior School of the Judges of the State of Tocantins (ESMAT), discussed topics on the transversality and interdisciplinary action of the new law. The agenda is still innovative and full of questions, requiring extensive discussion in various segments of society.

At the opening of the second day of debates, Justice Marco Villas Boas, president of Copedem, emphasized the positive comments about the event, as well as the broad participation of the registered. "We are receiving many constructive comments that encourage us to continue on this journey. I leave here my word and the mission of Copedem in these good practices of the Judiciary, that of improving every day our body of Judges and also our servers in the excellence of the juridiscional rendering, the promotion of fundamental rights, and the effectiveness of our federal constitution.

The moderator of the first part of the day, Judge Nelson Missias, from the Court of Justice of the State of Minas Gerais, reminded that the technological advances and the fast access to the international network anywhere in the planet also brought problems, such as the undue access to personal data. "Today we are victimized by hackers, we are victimized by people of bad faith all the time. Unfortunately, many people who receive data sharing do not know how to use it properly," he said.

In his speech, Minister João Otavio de Noronha, of the Superior Court of Justice, warned about the use of citizens' data by the Public Authorities and that the treatment of citizens' data is of an instrumental nature, since they are necessary instruments for the action of public activity on behalf of the data subjects themselves.  "This is a theme that will generate many questions. The possibility of their immediate transfer and the undue use of citizen data by the Public Power without respecting the strict purpose of their processing is not admissible by the Constitution nor by the general Law and can generate serious damages", he emphasized.

Next, two lectures were given, one by engineer Waldemar Gonçalves Ortunha Junior, an officer in the Brazilian Army (AMAN), and the other by the Attorney Ana Paula Bialer, leader of the Regulation and Internet WGT of the Association of Information and Communication Technology (TIC) and Digital Technology Companies (Brasscom), in which she presented important information about the still current topic.

Mediated by Judge Marcio Vidal, of the Court of Justice of the State of Mato Grosso, Director of the Antonio Rulli Júnior Institute (COPEDEM), the second part of the event had as speakers the lawyer Adriana Antunes Winkler, president of the Commission of Privacy and Protection of Personal Data of the OAB/DF; Professor Marcel Leonardi, PhD, from the Getúlio Vargas Foundation; and Glauce Karine Carvalhal, Legal Superintendent of the National Confederation of General Insurance, Private Pension and Life, Supplementary Health and Capitalization Companies - CNseg, who closed the activities.

Organized by the Center for Legal Memory (MEMORY), the event takes place in the form of explanatory panels and will feature various authorities in the legal field, among them the president of Copedem, Judge Marco Villas Boas, of the Court of Justice of the State of Tocantins; Minister João Otavio de Noronha, of the Superior Court of Justice; Minister Ricardo Villas Bôas Cueva, of the Superior Court of Justice; Minister Paulo de Tarso Vieira Sanseverino, of the Superior Court of Justice, and others. The third and last panel will take place next Monday (24th), starting at 9am.
