Tjto And The Government Of The State Of Tocantins Will Issue A Notice For Direct Precatory On Thursday (August 28th)

Justice Maysa Vendramini Rosal, president of the Court of Justice of the State of Tocantins (TJTO), and Irana de Sousa Coelho Aguiar, state general attorney, will sign on this Thursday (August 28th), at 2:30 pm, at the TJTO, a new notice addressed to creditors of interested state creditors in making a direct agreement to anticipate the receipt of their credits. The registration period will be from September 1st to October 15th, with no possibility of extension.

According to the TJTO, the initiative continues the success of the two rounds held in 2024, which included all creditors registered.

"The objective is to accelerate the discharge of these debts, benefiting both citizens and the fiscal management of the State, since the agreement allows the beneficiaries do not have to wait in the long line of chronological order of payments," explains president Maysa Vendramini Rosal.

In exchange for the anticipation, a discount is applied on the amount of the credit. "The percentages are lower than those practiced by the market and follow the State Decree no 6.711, of 2023, which defines the use of part of the resources for discharge of precatory," adds the managing Judge of Precatory, Odete Batista Dias Almeida.

The magistrate recalls that the modality is also provided for in the Resolution 303 of the National Council of Justice (CNJ), from 2019, and it should be conducted by the court that requested the precatory.

Rules of the notice

As anticipated by the justice, all creditors with precedents included in the chronological order list of the State may participate in this 3rd round of negotiations until April 2nd, 2025.

It will be accepted original owners, qualified heirs, lawyers with fees of succumb or contractual, and assignees with the transfer of credit already approved by the Justice. The proceedings may not have judicial pending or appeals on the values.

The expression of interest must be made in the electronic process of the precatory (2nd Degree), exclusively through a lawyer. It will be necessary to fill out the form available on the SITE of the TJTO and file a petition with the procedural motion: "Registered Petition Joined - Direct Agreement in Precatory".

The list of eligible creditors will be published by November 7th of 2025. After updating the values and final approval, it is expected that payments will be made by December 19th, 2025, directly to the account indicated by the creditor.

"Those who do not join or are not contemplated due to the limit of resources will remain in chronological order of payment, without prejudice to their rights," says Odete Almeida.

Until July this year, the state of Tocantins counted more than 5.3 thousand registrations, totaling approximately R$ 1.6 billion. The complete list is public and it can be consulted on this LINK.
