The Superior School of the Judges of the State of Tocantins (Esmat) received, on Tuesday (Nov 25th), the prosecutor of the National Treasury, Matheus Carvalho, to teach the panel on "Adherence to the Act of Registration of Prices in the Light of the New Law of Biddings", as part of the programming of the event on Public Management: Good Practices, Governance and Probity, held in the auditorium of the Court of Justice of the State of Tocantins (TJTO). The Board had as a discussant Judge Flávia Affini Adorno, director of the Palmas Forum.
With experience in the area and recognized for his engaging didactics, Matheus brought a clear and practical approach to one of the most relevant themes of contemporary public management: adherence to the price registration, mechanism often used by public bodies in processes of procurement of goods and services.
According to the lecturer, this form of hiring ends up being an increasingly common alternative for managers, especially in view of poor planning and budget limitation.
“We think we will study bidding and that our day by day will be bidding, but it is not. Our day by day is to find acts, adhere to acts, justify adherence to acts (...). The new law brings a structure of transparency that we have never had before in the history of this country", he pointed out.
Among the points discussed, Matheus explained that adherence to the acts can occur, for example, when the public body does not have enough budgets to hire all the necessary quantity, or even when there is no physical structure to receive the items at once. The use of acts then functions as a tool for contractual flexibility, provided that the principles of efficiency and legality are respected.
The relevance and impact of the class were highlighted by the participants. Larissa Oliveira Serra, lawyer and head of division in the General Directorate of External Control of the Court of Auditors of the state of Tocantins (TCE/ TO), stressed the importance of objective and didactic approaches on issues such as this.
"I’m suspect to talk about the experience, because I am a student of Professor Matheus since college and, more recently, I am also part of his project, the Specialist Reference, which is practically a complete universe on bidding. The professor has an incredible didactics, especially to deal with a subject that many people consider complicated. This way of teaching makes all the difference in learning and in the interest of those who are listening," she shared.
The practical applicability of the contents was another differential pointed out by the lawyer, especially in the context of implementation of the new Bidding Law by municipalities and state agencies.
“The approach was objective, easy to follow and at the same time deep. Such training is very necessary for civil servers of state and municipal public bodies, because the reality is that many municipalities are still adapting to the new Bidding Law. We, civil servers and lawyers, need to be increasingly prepared to give the appropriate support (...). I hope the professor will come back more often for events like this", commented.
Relevance of the theme For New Professionals
For those starting out in the area of Public or Administrative Management, the panel also had a significant impact. Student Mayara Brito, an ESMAT intern in the Control Supervision sector, commented on how the lecture contributed to broaden her understanding of administrative processes.
"The lecture of Professor Matheus was very enlightening and brought me a practical insight into how this procedure currently works. I found it important because it showed the rules, care and responsibilities involved in joining, something that often generates doubts on a daily basis", she said. In addition, Mayara also highlighted how the content dialogues with her performance within Esmat.
“For my work as an intern in the administrative sector, the topic is essential because it helps me to better understand the procurement processes, identify when adherence is possible and appropriate, and contribute more efficiently to the activities of the sector", she emphasized.
At the end of the lecture, the prosecutor thanked Esmat for the invitation and encouraged the participants to continue training. "Continue seeking to understand the news and details so that you can hire safely," he closed.
The event was promoted by Esmat, in partnership with the Court of Auditors of the state of Tocantins (TCE-TO) and the State Prosecution (MPTO), with the coordination of the assistant judge of the Presidency of the TJTO, Arióstenis Guimarães Vieira.
