Ai In The Judiciary In Focus: Regulated Innovation Is Discussed At The Opening Of The Second Day Of The XVIII International Congress On Human Rights

The opening of the second day of the International Congress on Human Rights was attended by the panel on Generative AI and the Judiciary, mediated by the executive director of Esmat, Ana Beatriz de Oliveira Pretto, with speakers from the Artificial Intelligence, assessor of the Superior Court of Justice (STJ), Dr. Amilar Domingos Martins and Doctor Professor Humberto Xavier de Araújo, scientific coordinator of the Interdisciplinary Laboratory of Artificial Intelligence of Esmat (LIIARES). 

In his speech, Dr Amilar Martins showed that the Generative Artificial Intelligence (IAG) is already a reality in the Brazilian Judiciary, and not just a future trend. Based on the survey on "Artificial Intelligence in the Judiciary 2024", of the CNJ, he highlighted that 45.8% of courts and councils already use GAI and that 81.2% of institutions that do not yet use express interest in adopting the technology, mainly to increase productivity, speed up the procedural process and reduce costs and repetitive tasks.

In framing this movement as an expression of the fundamental right to scientific progress and efficiency, the speaker recalled that the search for innovation is also a constitutional commandment. For the speaker, however, the regulation must also be propositive.

“CNJ and the courts must provide safe, auditable and regulated institutional tools, preventing isolated bans from pushing the system towards informal solutions. AI should be the tool. The human being must always be the end," he said. 

Then, Doctor Professor Humberto Xavier, president of the Institute for Attention to Cities (IAC), explained how emerging technologies such as Artificial Intelligence can support the Judiciary as automation of routines, monitoring of environment, decision based on jurisprudence and information with historical series.

The professor also explained how Large Language Models (LLMs) are already part of our daily lives, whether to create a recipe, improve a curriculum, write complex codes or even analyze a medical report and a court decision.

“When it comes to these more sensitive uses, legitimate concerns arise both about the quality of responses and about the privacy of the data involved. Still, the return obtained with the use of these tools is so palpable that it becomes unrealistic to imagine that we will stop using them", he said. 

On the occasion, the general director of ESMAT, Justice Marco Villas Boas, awarded the Feliciano Machado Braga Academic Merit Medal for the work developed in the academic research on Generative Artificial Intelligence in the state of Tocantins. 

LIIARES journal

During the panel, the executive director of the Superior School of the Judges of the State of Tocantins, Ana Beatriz de Oliveira Pretto, published LIIARES Journal, a scientific journal prepared by Esmat through the Interdisciplinary Laboratory of Artificial Intelligence of Esmat (LIIARES). 

Composed in its first edition of 12 scientific articles with interdisciplinary theme that discusses in the academic field the ethical use of Generative Artificial Intelligence resources, LIIARES Journal is born as a plural and interdisciplinary space dedicated to the production and dissemination of scientific knowledge applied in artificial intelligence, public innovation, digital governance and its approaches with the Law.

“It is an open access publication with international vocation reaffirming the commitment of Esmat to science, research and responsible technological transformation", said Ana Beatriz.  According to the executive director, the Journal will be published every six months.
