Tjto Opens The 17th Fonamec With Representatives Of All States And Defense Of Mediation As A Way Of Social Transformation

“Precisely because we believe in the transformative power of mediation and conciliation, we are so proud to be the stage for this debate," said Justice Maysa Vendramini Rosal, president of the Court of Justice of the State of Tocantins (TJTO), by officially opening the 17th National Forum on Mediation and Conciliation (Fonamec), on Monday (June 16th), in the city of Palmas.

Promoted by the TJTO, through the Permanent Center for Consensual Methods of Conflict Resolution (Nupemec), in partnership with the Superior School of the Judges of the State of Tocantins (Esmat), the event brings together representatives from the 27 courts of the country. With more than 300 registered, the 17th edition of Fonamec has as its central theme: "It is time to turn conflicts into opportunity for conciliation".

Justice Erik de Sousa Dantas Simões (TJPE), president of Fonamec, stressed the essential role of dialogue and self-composition to overcome conflicts. 

“The best thing to do is to settle by agreement between the parties. When there is no winner or loser, everyone wins", pointed out.

Organizer of the event, Judge Silvana Maria Parfieniuk, coordinator of Nupemec/ TJTO, emphasized that the forum is fundamental to strengthen the culture of peace, promoting self-composing methods that make the Judiciary more accessible, efficient and humanized. 

“Our goal is to disseminate conciliation, mediation and other consensual practices to resolve demands quickly, reduce processes and increase the satisfaction of the population", she said.

“Cejuscs are true laboratories of innovation and active listening, putting the human being at the center of judicial provision, guaranteeing lasting and pacifying solutions. Thus, we build a Justice that promotes social peace and strengthens citizenship", also highlighted Justice Angela Haonat, deputy director of ESMAT and coordinator of the Cejusc 2nd degree of the TJTO, during the opening ceremony.

Also formed the device of honor Justice Pedro Nelson de Miranda Coutinho, chief of Justice of the state of Tocantins; Justice Angela Prudente, ombudsman for Woman of the TJTO; Kátia Chaves Gallieta, Justice prosecutor; Pedro Alexandre Aires Gonçalves, general public defender of the State; Larissa Rosenda, vice president of the BAR/TO; Judge Julianne Freire Marques, vice president of AMB; Judge Allan Martins, president of Asmeto; and Rachel Tirello, president of Anoreg/TO.

Lecture

At the opening of the event, the participants attended the magna lecture on "Mediation and conciliation: Justice is in the dialogue", mediated by Justice Angela Haonat and Judge Silvana Parfieniuk.

On the occasion, the president of Fonamec shared two emblematic cases of conciliation in his performance in the Court of the state of Pernambuco. "We managed to mediate an agreement to compensate the residents of the so-called 'buildings-coffin', precarious constructions that caused dozens of collapses and more than fifty deaths. After much negotiation, we guarantee fair indemnities and the demolition of the real estate, avoiding new tragedies. Another example was the mediation between the State Prosecution and the City of Recife to implement inclusive education in 300 public schools - a quick solution that avoided years of litigation".

Also speaker, Justice Vanderlei Teresinha Tremeia Kubiak, 2nd vice president of the Court of Justice of the state of Rio Grande do Sul (TJRS), stressed the cultural change brought by the new Code of Civil Procedure, which prioritizes self-composition. According to her, "the priority of the Judiciary now is self-composition. What was once an exception has become the rule, because everyone should stimulate the search for agreements whenever possible". The magistrate also pointed out that mediation and conciliation enable more effective and lasting solutions, because they involve the active accountability of the involved.

Fonamec

Created in 2014, from the National Meeting of Centers and Conciliation Centers, Fonamec aims to strengthen the culture of mediation and conciliation in Brazil. The forum brings together annually representatives of the 27 courts of the country to align guidelines, share good practices and promote public policies aimed at consensual conflict resolution.

Based in the city of Palmas, the 17th Fonamec follows until June 18th, with thematic panels, practical workshops and presentation of innovative experiences of mediation and conciliation from different regions of the country.
