State Of Santa Catarina Shares Experiences On Mediation And Conciliation In The Second Degree During Fonamec

In its first edition in the state of Tocantins, the National Forum on Mediation and Conciliation (Fonamec) promoted on Tuesday (June 17th), a morning of debates about the challenges and perspectives of the culture of conciliation in the Brazilian Judiciary. Opening the work of the second day, Justice Sílvio Dagoberto Orsatto, from the Court of Justice of the state of Santa Catarina (TJSC), led the reflection on the challenges faced in the implementation of the Cejusc of 2nd Degree in the context of the TJSC.

With the theme on "Challenges in implementing the Cejusc of 2nd Degree in the TJSC: overcoming barriers to the effectiveness of Justice", the magistrate presented data and experiences that reflect a reality still under construction in many courts.

By addressing the cultural and structural barriers, Justice Sílvio reinforced that the Consensual Justice needs to be born of a change in mentality within the Judiciary itself. According to him, there is still a culture of only judicial solutions, which generates high economic and social costs.

"We add a cost to the Judiciary for not using these tools of the Consensual Justice," he pointed out, highlighting that resources that could be applied in health, Education and security are absorbed by disputes that could have been resolved by self-composing means. The magistrate also reinforced the strategic role of the Cejuscs of 2nd Degree as agents of institutional transformation.

“A fundamental role [of mediation and conciliation] is to bring to the courts a new way of thinking, to give an opportunity for this change to come from within, with the provision of judicial services within these two ways, that it offers a better method for achieving and, with this, the search for social pacification", he said.

During his speech, the Justice invited Chrystiane Maria Uhlmann, manager of Conciliation and Mediation of Cojepemec of the TJSC, to join him on stage. The magistrate stressed the relevance of the performance of the server in strengthening mediation practices in the context of the Justice of the state of Santa Catarina.

Presiding over the Table, Justice Ângela Issa Haonat, deputy director of ESMAT and coordinator of the Cejuscs of 2nd Degree of the TJTO, emphasized the importance of adapting good practices from other courts to the reality of the state of Tocantins. On a personal note, she recalled the times when the state of Tocantins, still part of Northern Goiás, was experiencing a historical delay in access to rights. As she explained, the Constitution of 1988 represented a milestone of social transformation, driving an explosion of judicial demands as an expression of citizenship.

"Every time is a time of change," said the justice, arguing that the second degree is a space for the flowering of Justice, due to the maturity and complexity of the processes that process there.

At the opportunity, the server Chrystiane drew attention to the importance of humanizing Justice, not only in serving parties and lawyers, but also in caring for their own mediators and conciliators. For her, it is necessary to look with attention to those who take care of the conflicts, ensuring qualification and well-being of these professionals who work on the front line of social pacification.

Promoted by the TJTO, through the Permanent Center for Consensual Methods of Conflict Resolution (Nupemec), in partnership with the Superior School of the Judges of the State of Tocantins (Esmat), Fonamec brings together representatives of the 27 courts of the country. More than 300 people are registered for this 17th Edition, which follows with programming throughout the afternoon, with the holding of five thematic workshops.
