Case Paranã: Seminar Promotes The Debate On The Process Of Land Regularization In The Municipality

Challenges such as document falsification, loss of registration and overlapping areas were the main points discussed in the panel on the process of land regularization in the city of Paranã, during the II Seminar of Land Regularization and the Real Estate Registry Service in the State of Tocantins, on Friday (August 16th). Judge Frederico Bandeira, from the Court of Justice of the State of Tocantins, presented the case as one of the most complex in the State, revealing the difficulties faced to ensure legal security in the region. 

During the explanation, the magistrate detailed the Mocambo operation, which was launched by the Special Action Group to Combat Organized Crime (Gaeco) in 2015, and resulted in the identification of about 20 forged documents, all created to legitimize the sale of irregular areas. "We are faced with the loss of almost five thousand registrations. Imagine the gravity of this! Almost 90% of the records were misplaced, compromising the legal security of the entire region", said Bandeira.

In all, 1,312 registrations were restored in the city of Paranã. "The operation of restoration of registration in the city of Paranã involved a rigorous analysis, with specialized technical support. With several orders issued from 2015, which allowed the regulation of the reconstitution of misplaced records, an essential solution to regularize areas and guarantee the ownership rights of owners", said the magistrate.

One of the debaters of the panel, Notary Herculano Bittencourt, holder of the Single Service Registry of the city of Conceição of Tocantins, highlighted the process of mapping confrontation, real-time monitoring of audio and video and document restoration. "There was a joint effort to restore the documents and restore trust of the citizens. It was a hard and continuous work, but absolutely necessary", he said.

The debater of the panel, the Judge coordinator of the Center for Land Prevention and Regularization (Nupref), Wellington Magalhães, added to the debate his experiences in dealing with similar situations in other counties. "In regions like Lagoa of Confusão, where I worked, we faced processes that lasted up to 20 years. Without technical intervention, such as surveying, there is no way to guarantee legal security for these communities".

Judge Frederico also highlighted the importance of the judiciary for pacification, with agreements for consensual solution, and the important partnership with the General Internal Affairs Department, through Nupref, for land regularization. "The land regularization goes beyond solving registration issues. It is about returning dignity and legal security to the people living in the region", he concluded.
