
The public notice for the 1st National Exam for Notaries (Enac) was published on Friday (January 24th). Held by the National Council of Justice (CNJ), in conjunction with the Getúlio Vargas Foundation (FGV), the aim of the exam is to enable candidates to register for public contests held by the Courts of Justice of the states and the Federal District and Territories, and aimed at the ownership of notaries and registry services.
The test is scheduled to be applied throughout the country on April 13th, 2025. The registration period runs from January 29th to February 27th. To register, those interested must fill out an application on the website of FGV. The registration fee is R$150 and it must be paid by February 28th. It is possible to request an exemption from the registration fee until January 31st.
As this is a qualifying exam, which is eliminatory and not classificatory, there is no implication of filling vacancies or competition. The qualification certificate will be valid for six years from the date of publication of the final result of Enac.
The public notice for the exam also states that the requirements for taking part in the National Exam for Notaries are Brazilian nationality (born or naturalized), or Portuguese nationality; to be over 18 years of age; and to have a degree of bachelor in law, with a registered diploma, recognized by the MEC, or to have worked for ten years in notary or registry services, completed by June 13th, 2025.
The exam will consist of 100 multiple-choice questions and candidates will be assessed on their knowledge of subjects such as notaries and registry law, constitutional law, administrative law, tax law, civil law and civil procedure, business law, criminal law and criminal procedure and general knowledge.
Candidates will be considered qualified if they obtain 60% or more correct answers in the test or, in the case of self-declared black, indigenous or disabled people, 50% or more correct answers.
Utilization
The National Chief of Justice, Minister Mauro Campbell, has decided on a proposal to amend the Resolution 541/2023 of the CNJ, with the aim of allowing the reciprocal use of the results of the hetero-identification carried out for the National Exam for Magistracy (Enam) or the National Registry Exam (Enac). According to the Chief of Justice, “the proposal aims to ensure greater administrative efficiency, avoid duplication of procedures and ensure predictability and legal certainty for the examinees, in line with the principles of economy and efficiency”.
The decision will still have to be approved by the full Plenary of the CNJ.
