Cnj: Justice And Health Award 2024 Will Recognize Best Judicial Practices In Health

Courts, Judges, public authorities, justice system bodies and civil society organizations will be able to apply for the Justice and Health Award of the CNJ from Monday (July 1st). Now in its second edition, the award is promoted by the National Council of Justice (CNJ) through the National Forum of the Judiciary for Health (Fonajus).

The award recognizes good judicial practices in the area of health that result in a reduction in the judicialization of the public and supplementary health and in the promotion of actions that contribute to legal, procedural and institutional security in health demands. Applications will be open until August 30th, 2024.

Ordinance No. 207/2024 establishes the rules, procedures and criteria for participation in the Award, which will cover five categories: Court, Judge, Justice System, Public Authority and Companies and Civil Society. Practices will be recognized for reducing the rates of judicialization of the public and supplementary health through the pre-procedural composition of conflicts, and actions to strengthen citizenship by promoting legal certainty in each of the five categories described. A total of 10 actions will be considered.

To take part, those interested must apply using the form available on the link Justice and Health Award - CNJ Portal and in accordance with the instructions and schedule published on the portal. The results will also be published on the CNJ Portal.

Encouraging good practices 

In 2023, more than 550,000 lawsuits were filed in the courts concerning health. Public health cases totaled 327,000 and supplementary health cases totaled almost 235,000 - some of these cases also deal with public health. In the same period, the courts heard 461,000 health cases and ended last year with a backlog of 754,000 pending cases.

Faced with this volume of lawsuits, Fonajus was created to propose concrete and normative measures regarding lawsuits involving health care. The Justice and Health Award of the CNJ aims to recognize good practices in the area of health and, for this reason, the winning practices developed by courts and the judiciary will be published on the Health section of the CNJ Portal of Good Practices of the Judiciary. The platform aims to share actions that contribute to the improvement of the Judiciary in the country.
