President Of The Tjto Opens State Meeting And Reinforces The Role Of Qualified Precedents In Promoting Legal Certainty

“The efficient management of precedents and the improvement of collective actions contribute to the optimization of the judicial activity, the reduction of repetitive and abusive demands, and the strengthening of legal certainty.” The statement was made by Justice Maysa Vendramini Rosal, president of the Court of Justice of the State of Tocantins (TJTO), at the opening of the First State Meeting on Precedents and Collective Actions of the Judiciary of the state of Tocantins, held on Friday morning (June 27th) in the auditorium of the TJTO.

Highlighting the importance of the initiative, the president emphasized that the event, promoted by the Management Center on Precedents and Collective Actions (Nugepac/TJTO), in partnership with the Superior School of the Judges of the State of Tocantins (Esmat), is aligned with the strategic goals of the National Council of Justice (CNJ). Among them, he cited Goal 1, which aims to judge more cases than are distributed; Goal 2, which prioritizes the judgment of older cases; and Goal 5, aimed at reducing the procedural congestion rate.

“I believe that it is through collaboration and the integration of knowledge that we build a Justice System that is more accessible to the population, more efficient and certainly faster," said the justice.

Instrument of changing

Justice Pedro Nelson de Miranda Coutinho, the chief of justice, also highlighted the complexity and importance of collective actions in the current scenario. “They are instruments capable of transforming social realities, ensuring, in a single process, the effectiveness of diffuse, collective and individual homogeneous rights,” he said. For him, the strengthening of qualified precedents is essential in this context, requiring specialized, sensitive and systemic treatment.

Justice Marco Villas Boas, general director of Esmat, addressed the evolution of the Brazilian legal system, highlighting the central role of the culture of precedents in stabilizing the legal system.

“This culture attaches importance to previous court decisions as guides for future cases, especially in the constitutional sphere, with the Federal Supreme Court playing a fundamental role," he explained, also mentioning the relevant role of the Superior Court of Justice (STJ).

Justice Adolfo Amaro, deputy judge and president of the Nugepac Management Commission, reinforced the aim of the meeting. “We want to strengthen the culture of qualified precedents, improve the use of technological tools in management and encourage debate on collective actions in the Justice System,” he said. For him, valuing precedents is strategic for ensuring legal certainty, procedural efficiency and achieving the goals of the CNJ.

Tribute

During the event, Justice Sérgio Luiz Kukina of the STJ was awarded the “Doctor Feliciano Machado Braga” academic merit medal, in recognition of his significant contribution to legal education and the modernization of judicial provision. The tribute also highlighted his work to make fundamental rights more effective and to strengthen the Democratic Rule of Law, as well as his relevant services to scientific research applied to innovation in the Brazilian Judiciary.

On the occasion, a plaque honoring the minister was also unveiled in the Gallery of Illustrious Visitors of the TJTO, and he signed the Book of Notable Records of the Court.

The event was attended by various authorities, including: Justice Habib Felipe Jabour, deputy superintendent of the 1st Vice-Presidency of the Court of Justice of the state of Minas Gerais; Justices João Rodrigues Filho (ombudsman of the TJTO), Euripedes Lamounier (substitute ombudsman), Ângela Prudente (ombudsman for women); and Judge Márcio Barcelos, convener of the TJTO; Miguel Batista de Siqueira, prosecutor; Irisneide Ferreira dos Santos, general sub-chief of justice of the State Public Defender's Office; Wagmar Roberto Silva, federal judge and member of the TRE-TO; Larissa Rosenda, vice-president of the BAR/TO; and Judge Allan Martins, president of the Association of Magistrates of the state of Tocantins.

Also present were other magistrates, civil servers, legal professionals and members of the community.
