
The Judiciary of the state of Tocantins started on Wednesday (June 4th) an online programming to celebrate the 30th anniversary of the Law that established the Special Courts in Brazil. The activity is part of the National Week of Special Courts and it is organized by the Superior School of the Judges of the State of Tocantins (Esmat), bringing together magistrates, servers and specialists to discuss the advances, the challenges and future of this important micro-system of access to Justice. The celebration reaffirms the commitment of the Judiciary of the state of Tocantins to promote access to Justice and modernize its practices for the benefit of the population.
At the opening of the event, Justice Maysa Vendramini Rosal, president of the Court of Justice of the State of Tocantins, recalled the period in which she worked as a magistrate of the special court. "I have already acted in the Special Court of the North Region, here in the city of Palmas, when it was still called Small Causes Court, and I can say that this instrument of the Judiciary here in the state of Tocantins has played an essential role in resolving quickly and effectively demands that directly affect the day-to-day life of the population”.
The president of the TJTO also reinforced the role of the Courts as a symbol of the democratization of the Judiciary.
“We live in a time when society demands more agile, efficient and human responses. And the Special Courts, with their vocation for dialogue and consensual resolution of conflicts, have much to contribute in this direction", she said.
The coordinator of the Special Courts of the Public Treasury, Judge Marcelo Faccioni highlighted the historical role of the Law and the Courts in the transformation of the Brazilian Justice system. "Three decades of commitment to social pacification, simplification of procedures and, above all, the appreciation of conciliation and dialogue. The success of this trajectory was only possible thanks to the commitment of magistrates, servers and other professionals who, day after day, dedicate themselves so that Justice is closer to those who need it most. This celebration is also a recognition to all that are part of this history", he said.
Lecture
As a follow-up to the activities, the lecture was given by the judge of the Court of Justice of the state of Minas Gerais (TJMG), Professor Maurício Cunha, who made an evolutionary analysis of the Special Courts of the Public Treasury. The speaker highlighted the historical origin of the micro system since the Conciliation and Arbitration Councils of 1982, the legislative changes over the decades, the most recent data from the Report in Issues 2024 of the CNJ, and practical aspects of the Law no 12.153, 2009, as competences, procedural subjects, absence of differentiated deadlines and necessary referral, compliance with judgment and the impact of the Theme 100 of the STF.
“The 30 years of the Special Courts reveal a trajectory marked by normative evolution and constant search for efficiency, especially in cases involving the Public Treasury", concluded the magistrate.
