
Held by the Superior School of the Judges of the State of Tocantins (Esmat), through a partnership with the University Center of the city of Brasília (UniCEUB), assistant Judge Esmar Custódio Vêncio Filho, of the Presidency of the Court of Justice of the State of Tocantins (TJTO), completed his Interinstitutional Doctorate in Law (Dinter), with the thesis topic: “Adolescent in Conflict with the Law with Mental Disorder: State Structure of Care and Public Policies in the state of Tocantins”, becoming the first academic on this doctorate to complete his research.
Qualitative in nature and using content analysis, the thesis is structured around the following question: “What are the implications of the lack of a minimally adequate state structure and public policies and budgets for the care of adolescents in conflict with the law with mental disorders?”. The study is divided into three phases: the first presents the legal framework and international parameters on the subject; the second analyzes the biases of the investigation of infractional conduct and the application of socio-educational measures; and the third addresses public policies directed at the problem.
According to Justice Marco Villas Boas, general director of Esmat, the academic training of magistrates and civil servers from the state of Tocantins results in better judicial provision, with more speed and effectiveness in the delivery of justice.
“We believe that investing in the academic and professional training of magistrates and civil servers has the effect of improving the quality of judicial service, and these results are already being seen by the people of the state of Tocantins,” he argued.
The new doctor expressed great satisfaction at the opportunity to carry out his academic studies at Esmat, highlighting the depth of the research and the richness of the program, which included four years of classes, in-depth methodological studies, writing articles and study groups.
“The study included an analysis of the service structure in some States and interviews with judges in Tocantins, using the theory of social representation to understand their perceptions of the local structure and its impact on the work of the Child and Youth Justice system,” he said.
Applicability
The thesis in question has practical applicability in several areas. Firstly, its results can support the formulation of more effective public policies for the care of adolescents in conflict with the law who have mental disorders, guaranteeing the protection of their rights and access to comprehensive health care, as well as improving the structure of the care and monitoring network for these adolescents, promoting the training of professionals and the creation of specialized services.
